Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used.

This notice applies to all information collected from or submitted to all Samaa television web sites (referred to as “our web sites” from here on). This refers to www.samaa.tv and the affiliated Samaa television programme web sites and any others under the umbrella of Jaag Broadcasting Systems Pvt. Ltd.

Samaa and its affiliates are not responsible for the content of external internet sites. Our web sites contain links to other web sites operated by third parties. Samaa is not responsible for the privacy practices or policies of such third party web sites and this notice does not apply to those web sites.

As with all internet or online exchanges or interaction, we advise you against sharing or publishing any personal information that could be used to your detriment or harm. We recommend that you do NOT share your passwords or personal information with anyone.

Personal Information

Non-Account Activity. You can access, read, watch and listen to video, written and audio material published on Samaa without having a Samaa account.
Account-Related Activity. Certain other activities on Samaa - like posting comments - require you to have a Samaa account. We ask for some personal information when you create a Samaa account, including your email address and a password, which is used to protect your account from unauthorized access.
Usage Information. We may record information about your usage, such as when you use Samaa.
Content Uploaded to Site. Any personal information or video/audio/written content that you voluntarily disclose online (on discussion boards, in messages and chat areas, etc.) becomes publicly available and can be collected and used by others. It may also be used by Samaa, if it so chooses, on any of its platforms.

Uses

If you submit personally identifiable information to us through the Samaa Sites, we use your personal information to operate, maintain, and provide to you the general and personalized features and functionality of the Samaa Sites, and to process any flagging activity or correspondence you send to us.
Your account name (not your email address) is displayed to other Users when you upload material or send messages through the Samaa Sites. Any material that you submit to the Samaa Sites may be redistributed through the internet and other media channels, and may be viewed by the general public.
We use both your personally identifiable information and certain non-personally-identifiable information to improve the quality and design of the Samaa Sites.
We use cookies, clear gifs, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit the Samaa Sites; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.

Information That is Publicly Available

When you create an account on the site, some information about your account and your account activity will be provided to other Users of the site. This may include the date you opened your account, the date you last logged into your account, your age (if you choose to make it public), the country and the number of material you have accessed.
Your account name (not your email address) is displayed to other Users when you engage in certain activity on the site. Other Users may contact you through messages and comments.

Third-party Advertisers, Links to Other Sites

Samaa allows other companies, called third-party ad servers or ad networks, to serve advertisements within the Samaa Sites. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Samaa Sites. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see. Samaa does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. However, please note that if an advertiser asks Samaa to show an advertisement to a certain audience (for example, men ages 18-34) or audience segment (for example, men ages 18-24 who have viewed certain channels of content) and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. The advertiser may also use information regarding your use of the Samaa Sites, such as the number of times you viewed an ad (but not any personally identifiable information), to determine which ads to deliver to you.

You should consult the respective privacy policies of these third-party ad servers or ad networks (see links below) for more information on their practices and for instructions on how to opt-out of certain practices. Samaa's privacy policy does not apply to, and we cannot control the activities of, such other advertisers or web sites. Any data obtained by third-party ad servers subsequently shared with Samaa is maintained and dealt with by Samaa in accordance with this privacy policy.

Mobile- or PDA-specific information we collect

Most of the personally identifying information we collect is what you tell us about yourself. For example, certain of our products and services allow you to interact and share personal information and data with others. You choose what you want to share and how you want to share it.
Sometimes, we record your phone number. We record your phone number when you send it to us; ask us to remember it; or make a call or send a text message or SMS to or from Samaa. If you ask us to remember your phone number, we will associate your phone number with your Samaa Account, or, if you do not have a Samaa Account, with some other similar account ID. We often generate this account ID based on your device and hardware IDs, so if you change your device or hardware, you will have to re-associate this new device or hardware with your account before we can authenticate you.
Most of the other information we collect for mobile, such as your device and hardware IDs and device type, the request type, your carrier, your carrier user ID, and the content of your request, does not by itself identify you to Samaa, though it may be unique or consist of or contain information that you consider personal.
Certain of our products and services allow you to personalize the content you receive from us. For these products and services, we will record your preferences and any information you provide about yourself or your interests (such as a list of your stocks to personalize your stock listings).

Uses

We use your information to process and personalize your requests. We also use the information for support, to develop new features, and to improve the overall quality of Samaa's products and services.
We may also use the information to show you a history of your activity, to provide you with statistics about you or your use of our product or service, or to provide you with a better user experience.

Information sharing and onward transfer

All requests must be sent through your mobile carrier's network and your carrier may have access to it. For information regarding your carrier's treatment of your information, please consult your carrier's privacy policies.
We may share your information with certain third parties we use to perform certain functions, such as billing and text message or SMS delivery. These third parties will be contractually bound to treat your information in accordance with the applicable Samaa privacy policies.
Certain of our products and services allow you to interact and share your information with others. Please consider carefully before disclosing any personal information or data that might be accessible to others.

The Information We Collect

Our web site does track certain information about the visits to our web site(s) and we reserve the right to use that information for our purposes. We will not, however, divulge your personal information.

In a few areas on our Web site, we ask you to provide information that will enable us to verify whether you are entitled to access and use certain information, materials and services available from our web site, or to enable us to enhance your site visit, to assist you with customer service or technical support issues, or to follow up with you after your visit, or to otherwise support your customer relationship with Samaa. It is completely optional for you to participate. However, failure to participate may mean that you cannot access and use certain information, materials and services.

We may typically ask for your name, email address, phone number, address, Samaa ID and password, as well as other similar personal information that is needed to register or subscribe you to services. On occasion, we may ask for additional information to enable us to provide you with access to and use of certain information, materials and services. In the case of newsletters or mailing lists or RSS feeds etc., you will be able to "unsubscribe" at any time.

The personal information you provide to us when using our web site, such as your name, postal or email address or telephone number will be kept confidential and used to support your relationship with Samaa.

ACCESS TO SERVICES

Only individuals authorized by the subscribing organization may access and use the Online Services.
Your identification number(s) may be restricted from accessing certain Materials otherwise available in the Online Services.
Materials and features may be added to or withdrawn from the Online Services and the Online Services otherwise changed without notice.

LIMITED WARRANTY

The provider of the Online Services represents and warrants that it has the right and authority to make the Online Services and Materials available pursuant to these General Terms and Conditions.

EXCEPT AS OTHERWISE PROVIDED ABOVE, THE ONLINE SERVICES AND MATERIALS ARE PROVIDED ON AN "AS IS", "AS AVAILABLE" BASIS AND THE PROVIDER OF THE ONLINE SERVICES AND EACH THIRD PARTY SUPPLIER OF MATERIALS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

LIMITATION OF LIABILITY

A Covered Party (as defined below) shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from (a) any errors in or omissions from the Online Services or any Materials available or not included therein, (b) the unavailability or interruption of the Online Services or any features thereof or any Materials, (c) your use of the Online Services or Materials (regardless of whether you received any assistance from a Covered Party in using the Online Services), (d) your use of any equipment in connection with the Online Services, (e) the content of Materials, or (f) any delay or failure in performance beyond the reasonable control of a Covered Party.

"Covered Party" means (a) the provider of the Online Services, its affiliates, and any officer, director, employee, subcontractor, agent, successor, or assign of the provider of the Online Services or its affiliates; and (b) each third party supplier of Materials, their affiliates, and any officer, director, employee, subcontractor, agent, successor, or assign of any third party supplier of Materials or any of their affiliates.

THE AGGREGATE LIABILITY OF THE COVERED PARTIES IN CONNECTION WITH ANY OTHER CLAIM ARISING OUT OF OR RELATING TO THE ONLINE SERVICES OR MATERIALS SHALL NOT EXCEED THE AMOUNT OF YOUR ACTUAL DIRECT DAMAGES. YOUR RIGHT TO MONETARY DAMAGES IN THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMEDIES WHICH YOU MAY HAVE AGAINST ANY COVERED PARTY.

THE COVERED PARTIES SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THE ONLINE SERVICES, MATERIALS, OR THE FAILURE OF ANY COVERED PARTY TO PERFORM ITS OBLIGATIONS, REGARDLESS OF ANY NEGLIGENCE OF ANY COVERED PARTY
